CRICKETOLOGY REGISTRATION: |
Registration is mandatory and is further described below.
By using the Website and the Service, you represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information.
You further represent and warrant that you are 18 years of age or older and that your use of Cricketology.com shall not violate any applicable law or regulation. Your Membership is solely for your personal use, and you shall not authorize others to use your account, including your profile or email address.
You are solely responsible for all Content published or displayed through your account, including any email messages, and for your interactions with other Members.
As part of the registration process, you will be asked to select a username or alternatively enter your mobile number along with a password or alternatively your assigned 16-digit PIN and you will be responsible for all activities occurring under your username and for keeping your password/PIN secure.
We may refuse to grant you a username that impersonates someone else, is or may be protected by trademark or proprietary rights law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.
To access the Game, log-on to the Cricketology.com Home page (www.cricketology.com). To play the Game, you must be a registered Member of Cricketology.com.
Registration is FREE.
A user may register by clicking on the applicable link on the entry page for the Game and following the instructions. User will be asked to provide an e-mail address, a username, a mobile number, birth date, gender, a valid Indian postal address (for the purpose of delivering prizes) and to select a password. To complete his/her entry, Member must click on the "Accept Terms" button.

HOW TO REGISTER:
|
Register Online. Log on to the Cricketology Home page (www.cricketology.com) and after filing out the required information click on the "Submit" button.
Void:
Use of any automated system (e.g., robots, automatic, macro, programmed or like entry methods) or submission of multiple entries is prohibited. Any attempt by any Member to use an automated system or manual attempts at keying in membership PINs for the purpose of adding Points to his/her account will void all of that Member's entries, and render that person ineligible to receive any of the prizes. Entry materials/data that have been tampered with or altered are void.
Entry Errors:
The Company is not responsible for lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified.
The Company is not responsible for any unavailability of or interruptions to any service or equipment used in connection with the Game including, without limitation
- interruptions to any network, server, Internet website, telephone, satellite, computer
or other connections,
- failures of any telephone, satellite, hardware, software or other equipment,
- garbled, misdirected or jumbled transmissions, or traffic congestion,
- other errors of any kind, whether human, technical, mechanical or electronic, or
- the incorrect or inaccurate capture of entry or other information or the failure
to capture any such information.
No Return of Entries; Disputes:
Once submitted, entries become the sole property of Company and will not be acknowledged or returned. In the event of a dispute as to any entry, the authorized account holder, i.e., natural person, of the email address used to register will be deemed to be the registrant. Potential winners will be required to show proof of identification. Company may require that the potential winner provide proof that he/she is the authorized account holder of the email address and/or password associated with the user account.

GENERAL ITEMS:
|
General
The objective of the Game is to accumulate the most points by the end of a given
series by correctly selecting the "winning options" for any or all provided plays
for any given match.
Cricketology is a series-by-series game.
How To Play
Members may begin by following the instructions in the How To Play section of the
cricketology.com.
All Plays Are Final
Once a Member makes a pick and selects Play, that pick, the attached Bonus Factor
and the involved points will not change.
Points are updated after a result is completed. Points are tallied or scored, and
updated rankings are posted when a result becomes final.
All game and event times are Indian Standard Time (IST).
Eligibility
The Game is open to legal residents of India and Non-Resident Indians with a valid
Indian address, who are 18 years of age or older as of the date of entry.
All users/members playing the Cricketology game on each match day will be required
to answer correctly a cricket related question from a set of multiple choice answers.
Users answering the question correctly are eligible to have their plays registered
and failure to answer the Question of the Day, will result in an invalid entry and
forfeit of points in play.
The following are not eligible for the Game:
- employees and agents of Skilworth Technologies Private Limited and their respective
parent, subsidiary and affiliated companies, and their respective advertising/promotion
agencies; and
- any other person who is a relative of the employees and agents of Skilworth Technologies
Private Limited and their respective parent, subsidiary and affiliated companies,
and their respective advertising/promotion agencies.
For the purpose of clause (ii) relative shall have the same meaning ascribed to
it as contained in Section 6 of the Indian Companies Act, 1956.
Scoring
From all eligible entries received, the winners will be determined based on their
ability to use their skill and knowledge of cricket through the art and science
of cricketology to accumulate the most points during the Series. A Member accumulates
points from his first winning play. He may make plays on any or all games, with
some or all of his available points.
Bonus Factors / Multipliers
Cricketology.com generates its own Bonus Factors /Multipliers with the help of a
panel from the University of Cricket, for each cricket match/event/outcome.
Mandatory Question
Each user must answer one mandatory cricket related question on each day that he/she
makes a play on the site. Failure to answer this Question of the Day will result
in an invalid entry and the system will deduct points that are in play for the day,
without registering the user's play.
Cut Off-Time
During each match, there will be Cut-Off times determined by Cricketology and its
expert panel, which will trigger a “system lock" and prevent further entries for
the respective questions.
The Company’s computer is the official time keeping device for this game.
Umpires And Referees
The decisions of ICC officials/scorekeepers responsible for officiating the games
shall be final and binding regarding the outcome and scoring of each match.
Prizes
- Each contestant is entitled to a prize based on his/her total available points in
the user account.
- Prizes can be redeemed against the total number of points in balance in the user
account.
- Redemption of points for prizes is permitted at the end of each series.
- Prizes in each category is subject to availability.
- Members wishing to purchase additional points for redeeming a prize more than the
points in the account, are permitted to do so.
- The Prize Catalogue is updated from time to time and Cricketology.com may change/replace
the prizes on offer in each category without prior intimation to users.
- No Prizes are EVER redeemable or exchangeable for cash.
- The mathematical possibilities of winning prizes depend on the relative cricket
knowledge of all Members.
- Substitution- No cash or other prize substitution or transfer of prizes is permitted.
- Taxes - THE WINNER IS SOLELY RESPONSIBLE FOR TAXES ASSOCIATED WITH THE RECEIPT OR
USE OF ANY PRIZE.
- Prize Delivery- Prizes will be delivered only to a valid Indian address. Prize winners
will need to provide proof to address to collect prizes. Prize Winners should allow
up to 6-8 weeks after they return their signed form (or digital form) to receive
their prize. Prizes returned as undeliverable or otherwise not claimed within twenty-one
(21) days after being sent will be forfeited.
No Warranty
Members acknowledge that Company, Presenter and each of their respective agencies
or related companies have not made nor are in any manner responsible for any warranty,
representation or guarantee, express or implied, in fact or in law, relative to
any prize, including but not limited to its quality.

Potential Winners
|
1. Verification.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SKILWORTH, WHOSE DECISIONS
ARE FINAL. SKILWORTH SHALL SOLELY DETERMINE ANY FORM OF VERIFICATION. AN ENTRANT
IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT'S ELIBIGILITY AND THE POTENTIAL
WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION
IS COMPLETE. SKILWORTH WILL NOT ACCEPT SCREEN SHOTS, AFFIDAVITS OR OTHER EVIDENCE
OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM
HAS FAILED FOR ANY REASON MAY BE DEEMED A DEFECTIVE ENTRY AND VOID.
2. Release
By participating in this Promotion or receiving a prize, entrants (and in particular,
winners) agree to release and to indemnify and hold harmless the Company, and each
of their respective related companies, and all of its or their company's officers,
directors, employees and agents (collectively, the "Released Parties") for any liability,
injury, death, loss or damages to entrant or any person or entity, including without
limitation damage to personal or real property, caused in whole or in part, directly
or indirectly, by participation in this Promotion (or related activities) or the
acceptance, possession or use/misuse of a prize (including any travel or activity
related to the prize).
3. Publicity
Except where prohibited, participation in this Game constitutes winner's consent
to Company and its or their agents' use of winner's name, likeness, voice, opinions
and biographical information for publicity, advertising, trade or promotional purposes
in any media or manner, now known or hereafter devised, worldwide, without further
payment, consideration, notice or approval.
Promotion of Prizes
Cricketology.com’s current offering is a PROMOTION INTENDED FOR ALL INDIANS WITH
A VALID INDIAN ADDRESS AND IS ALSO OPEN TO FOREIGNERS RESIDENT IN INDIA.

ELIGIBILITY FOR PRIZES. |

The Game is purely a game of skill, that aims at helping cricket fans use their
full knowledge of the science and logic in the decision making process of each event
in a game of cricket.
Participation in the Game constitutes Member's full and unconditional agreement
to these Official Rules and the Company’s decisions. Winning a prize is contingent
upon fulfilling all requirements set forth herein. From all eligible entries received,
the winners will be determined based on their ability to use their skill and knowledge
of popular cricket to accumulate the most points in this game.
GAME TERM: The Game begins on March 1st, 2007 and will end at the end on April 30th,
2007.
All subsequent series or Championships shall be notified from time to time, with
specific terms described. For the purposes of these Official Rules all times are
Indian Standard Time ("IST").
EARLY PLAYS IN GAMES WHICH ARE LATER CANCELLED: In sports like cricket where weather
or other factors can lead to a game ultimately being postponed or cancelled, the
early plays by members will still count and be graded. For instance, if the first
inning is completed and the game is later cancelled due to bad weather, the play
made on the outcomes of the first inning will still stand (despite the match not
offering a final result).
For rain-affected or cancelled games, all plays made on outcomes such as WHO WILL
WIN, will be treated as void and points will be reversed to member accounts. All
plays made on games that are tied will be reversed on to member accounts.

CRICKETOLOGY provides information and recommendations intended for entertainment
only, specifically for playing the online/mobile phone based sports and entertainment
competition at Cricketology.com. The website through its service allows cricket
fans worldwide to challenge, communicate and compete.
You must be 18 years old, or older, to use this service. Past performances do not
guarantee future results. We cannot guarantee that all information provided in our
services is 100% accurate.
Any use of this information in violation of any national, state, local laws is prohibited.
The Site does not endorse, engage in, or provide any gambling or gaming activities
and does not accept or place wagers of any kind. Promotion of gambling sites is
forbidden from this service.
All plays are the property of Cricketology.com. Any members that either post the
leading plays on the Internet, send them to group emails, or attempt to charge others
for those plays will have their service stopped immediately with no refund. These
persons may also be subject to additional charges.

GAME MODIFICATION:

Company reserves the right, in its sole discretion, to modify, cancel, terminate
or suspend this Game without advance notice for any reason including, without limitation,
if (i) viruses, bugs, unauthorized human intervention, fraud, technical failure
or other causes which corrupt or affect the administration, security, fairness,
integrity or proper conduct of the Game; or (ii) earthquake, flood, fire, storm
or other natural disaster, act of God, labor controversy or threat thereof, civil
disturbance or commotion, disruption of the public markets, war or armed conflict
(whether or not officially declared). In such event, all members will be entitled
to a prize valued on the cumulative points in his/her account, at the time of such
cancellation, termination or suspension, or in such other fashion as shall be considered
equitable in the sole discretion of the Company.

LIMITATIONS OF LIABILITY:
|
The Released Parties are not responsible for: (1) any incorrect or inaccurate information,
whether caused by Members, printing errors or by any of the equipment, hardware,
software or programming associated or used with the Game; (2) technical errors,
defects, delays or failures of any kind including, without limitation, malfunctions,
interruptions or disconnections in communications lines, Internet or website access,
hardware or software; (3) digital or electronic disruptions, e.g., viruses other
security breaches; (4) unauthorized human intervention, e.g., hacking; (5) technical
or human error which may occur in connection with any aspect of the Game; (6) any
injury or damage to persons or property which may be caused, directly or indirectly,
in whole or in part, from Member's participation in the Promotion, access to, copying
or downloading materials from cricketology.com or any other website, or receipt
or use of any prize.
UNDER NO CIRCUMSTANCES WILL CRICKETOLOGY BE LIABLE TO YOU OR ANY THIRD PARTY FOR
ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT
OF OR IN CONNECTION WITH USE OF THE CRICKETOLOGY SERVICE, INCLUDING LOST PROFIT
DAMAGES ARISING FROM YOUR USE OF THE WEB SITE OR THE SERVICE, WHETHER OR NOT CRICKETOLOGY
HAS BEEN ADVISED OF THE POSSIBILITY OF ANY DAMAGES. SUCH LIMITATION OF LIABILITY
SHALL APPLY (I) WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON
THE CRICKETOLOGY SERVICE, FROM INABILITY TO USE THE CRICKETOLOGY.COM SERVICE, OR
FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE CRICKETOLOGY.COM SERVICE
(INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES), AND (II) NOTWITHSTANDING ANY
FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED
BY LAW. UNDER NO CIRCUMSTANCES SHALL CRICKETOLOGY.COM BE LIABLE TO YOU FOR ANY AMOUNT.

DISPUTES/CHOICE OF LAW:
|
Except where prohibited, each Member agrees that: (i) all issues and questions concerning
these Official Rules shall be governed by Indian law without giving effect to any
principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims
and causes of action at law or in equity arising out of or relating to this Game
or any prize awarded shall be:
- settled by arbitration in accordance with the provisions of the Indian Arbitration
and Conciliation Act, 1996 or any enactment of statute that may have amended or
accordingly replaced the same.
- The arbitral tribunal shall be composed of three arbitrators, one arbitrator to
be appointed by each party and a third arbitrator to be appointed by such arbitrators.
- The place of arbitration shall be Chennai, India and any award whether interim or
final, shall be made, and shall be deemed for all purposes between the Parties to
be made, in Chennai.
- The arbitral procedure shall be conducted in the English language and any award
